Title 38 USC 3670(e) Compliance Policy

To establish SUNY Plattsburgh's policy for compliance with Title 38 USC 3679(e) concerning the educational benefits available to veterans, service members and their dependents under the GI Bill and related programs.

Student veterans, service members and their dependents.

Covered Individuals: A covered individual under this policy is any individual who is entitled to education assistance under:

• Chapter 31, Vocational Rehabilitation and Employment, or
• Chapter 33, Post-9/11 GI Bill® benefits.

SUNY Plattsburgh will:

1. Pending Payment: Permit any covered individual to attend or participate in courses while awaiting VA payment.
2. No Penalties: Refrain from imposing any penalties for the delay in VA disbursement, including:
• The assessment of late fees,
• Denial of access to classes, libraries, or other institutional facilities, and/or
• Requiring covered individuals to secure alternative funding.
3. Required Documentation: To qualify for these protections, the covered individual must provide the institution with the following:
• A certificate of eligibility for entitlement to educational assistance under Chapter 31 or 33,
• A written request to use such entitlement,
• Any additional information needed to properly certify enrollment and ensure the timely receipt of VA benefits.

Duration:
This policy will be applicable from the date the covered individual provides the required documentation until the earlier of the following dates:

• The date payment is made by the VA to the institution, or
• 90 days after the institution has certified tuition and fees following receipt of the required documentation.

Institution’s Rights:
While SUNY Plattsburgh will not impose any penalties as outlined above, the institution reserves the right to:

• Require the covered individual to submit necessary documents for certification,
• Seek payment for any outstanding balance not covered by the VA.

Appeal Process:
Covered individuals who believe they have been subject to penalties in violation of this policy may appeal by contacting the Director of Student Financial Services for resolution.

Policy Review:
This policy will be reviewed annually by Student Financial Services to ensure compliance with all applicable laws and regulations.
